“You have to work with them to insure that these things don’t happen,” Minot Skyrockets coach Daleo said, relating the story of a player that signed with him during his time at Rockford who went to play for a European league in violation of his contract.  FIBA had to step in and resolve the dispute under its rules.

“The ABA is not governed by the [USA Basketball] or FIBA,” claims Yam, “so Buffalo does not own the rights to Dayshawn or any other player on their team for that matter.”

Not true. Contracts signed by players are standard state civil legal agreements.  USA Basketball and FIBA only work out disputes between their member clubs to speed up the player acquisition process. 

Players drafted outside of the USA/FIBA system have no less draft standing with the organization conducting the draft either, even if those bodies don’t recognize the draft.

If the player signs a contract with the non USA/FIBA club, they are are still bound to their clubs, per the terms of the agreement, by civil law.  If they bolt, they run the risk of having their career move stalled in the civil court system for months or years.

Wright could face that fate.  Weir was unclear as to whether he would enforce his agreement.

“I haven’t decided yet. For me, it hurts more personally than economically, he told MLN.

“I could probably keep the kid out of basketball all next year. But I don’t want to, because the kid has raw talent that, properly developed, could change his whole life.  I can’t understand why he didn’t speak to us.”

“(Minot) signing him would be a destructive precedent,” noted Newman.

Canned Yam?

Yam, Dayshawn’s agent, says he did not approve Wright’s contract with Buffalo and didn’t start representing his client until August.  Yet Yam himself may not even have the legal right to represent Wright.
